The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicants have certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant’s consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2008-0748, The Suffolk County Department of Public Works, 335 Yaphank Avenue, Yaphank, Suffolk County, has applied to the U.S. Army Corps of Engineers, New York District, for a permit to dredge with ten years maintenance, a navigation channel at Strongs Creek , Village of Lindenhurst, Town of Babylon, Suffolk County. Approximately 20,000 cy of dredged material will be removed from a channel 5,900 ft. long x 100 ft. and variable wide x 6 ft. below mean low water (MLW). The surplus material will be placed west of the channel in an existing upland diked surplus area on Indian Island (County Park Land).
The stated purpose of the above mentioned proposal is to maintain navigable water depths for the vessels that use the waterway during the ten-year period of the requested permit.
Any interested parties and/or agencies desiring to express their views concerning the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 30 days from the date of publication of this notice, or, January 9, 2009.

In F-2008-0833, The Orient Wharf Company, Village Lane, Orient, Town of Southold, Suffolk County, has applied to the U.S. Army Corps of Engineers, New York District, for a permit to dismantle the existing wharf by the following proposed activities: to remove ±100 lf. of wood sheathing, remove and stock-pile the existing rip-rap for re-use, remove the understructure and excavate, dredge a 30' x 60' area to -2' AML with resultant spoil (±75cy) to be dewatered and trucked off-site, install three (3) concrete oval culverts at 58" x 91" tall/wide x 56' long at 18" below ALW, backfill and re-install rip-rap, refurbish roadway and curbing.
The stated purpose of the above mentioned proposal is wharf reconstruction/repair, and to re-establish tidal flow through the existing filled pier.

The applicants have certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. In F-2008-0630, Buffalo Riverfest, LLC, has applied to the U.S. Army Corps of Engineers, Buffalo District, for a permit to reconstruct a portion of a delapidated wharf, install a floating dock assembly and reconstruct an existing storm water outfall in conjunction with the creation of a public park in an adjacent abandoned area at 215 Ohio Street, Buffalo, NY.
Specifically, the proposal includes the following:
• Reconstruction of an existing delapidated wharf to a size of approximately 89' along the shore of the Buffalo River. The wharf is proposed to project approximately 45' river-ward of the existing shoreline and will be supported by existing piles where available.
• Construction of an approximately 6' by 100' floating dock structure, downstream of the proposed wharf.
• Repair of an existing stormwater outfall and treatment of stormwater prior to its discharge into the Buffalo River.

In F-2008-0885, Highland Estates, LLC, Thornwood, NY, has applied to the U.S. Army Corps of Engineers, New York District, for a permit to fill federal wetlands at the intersection of Mack Lane and US Rt. 9W, in the Town of Lloyd, Ulster County in conjunction with a commercial development to include restaurant and retail space.
Specifically, the proposal includes filling 0.27 acres of wetlands under federal jurisdiction and mitigating this with the establishment of 0.31 acres of constructed wetlands adjacent to the site of the proposed development. The proposed activity includes the discharge of stormwater runoff into adjacent wetlands after treatment in an onsite stormwater retention pond. The activity is proposed to be conducted in two phases; phase I proposes to construct a 7,200 sqft restaurant facility and a 14, 608 sqft retail facility with the associated parking, road, stormwater and utility infrastructure, whereas phase II proposes two additional retail facilities of 15,000 sqft and 3,000 sqft with the associated facilities described above. Phase II will require the construction of an additional stormwater detention pond.

The United States General Services Administration, has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2008-0937 DA, the U.S. General Services Administration, is proposing to modernize the Alexandria Bay Land Port of Entry located on Wellesley Island in Jefferson County, NY. The expansion involves the addition of new buildings and roadway re-configurations.
Specifically, the General Services Administration’s proposed project involves:
• acquiring property from the Thousand Island Bridge Authority, New York State Department of Transportation, Jefferson County, and four private land owners.
• expanding primary and secondary commercial inspection areas
• expanding the existing queuing areas
• expanding and reconfiguring the commercial circulation area
• adding a new non commercial primary inspection facility
• adding new primary inspection booths
• adding a new bus passenger inspection lane
• adding elevated staff parking facilities that will additionally serve as a canopy over the inspection lanes
• improving the existing County Road 191 interchange
• installation of a new wastewater treatment facility
• installation of stormwater infrastructure to contain excessive stormwater runoff on site

The proposed work is also located within a Scenic area of Statewide Significance (SASS).
The stated purpose of the proposal is to construct a multi-family development and associated features including road, stormwater management basin, utilities and grading at 46 West Market Street, Village of Rhinebeck, Dutchess County.
