Sag Harbor

The Village of Sag Harbor completed preparation of a Local Waterfront Revitalization Program (LWRP) which is a locally prepared, comprehensive land and water use plan for the Village's natural, public, working waterfront, and developed waterfront resources. The Sag Harbor LWRP provides a comprehensive framework within which critical waterfront issues can be addressed and planned waterfront improvement projects can be pursued and implemented. The Village of Sag Harbor LWRP is a comprehensive coastal management program that is based on the policies of the New York State Coastal Management Program.

The Village also completed preparation of a Harbor Management Plan (HMP) which sets forth the Village's vision for its harbor area. The plan addresses the problems, issues, and opportunities related to the use of its harbor, including the lands adjacent to it that may play a role in the uses of the harbor. In particular, the HMP seeks to resolve conflicts between competing uses and to allocate surface water uses. As an approved component of an LWRP, the HMP would require federal and state actions, such as funding, permitting, approval and direct actions, to be consistent with the plan.

The Village of Sag Harbor prepared its LWRP and HMP with assistance from the New York State Department of State and in accordance with the New York State Waterfront Revitalization of Coastal Areas and Inland Waterways Act and the New York State Coastal Management Program. Chapter 791 of the Laws of New York of 1992 amended Article 42 of the New York State Executive Law (Waterfront Revitalization and Coastal Resources Act) to provide local governments with the authority to comprehensively manage the uses in their harbor areas by developing a HMP and adopting the laws to implement the plan.

The Sag Harbor Board of Trustees adopted their LWRP on May 6, 1986, adopted their HMP on December 1, 1998 and adopted amendments to both the LWRP and HMP on February 14, 2006. The LWRP, the HMP and their amendments were subsequently approved by the New York State Secretary of State and concurred by the U.S. Office of Ocean and Coastal Resources Management.

The eight sections of the LWRP are:

 

Section I - Waterfront Revitalization Area Boundary - - This section provides a detailed narrative and graphic description of the waterfront revitalization area boundary.

Section II - Inventory and Analysis - - This section describes the existing natural and man-made environments and conditions within the waterfront area, as well as analysis of opportunities and constraints to development.

Section III - Waterfront Revitalization Policies - - This section presents the coastal management policies that apply to the Village of Sag Harbor's Local Waterfront Revitalization Area (LWRA). The policy and sub-policy explanations of the New York State Coastal Management Program have been modified and expanded to reflect the unique conditions of Sag Harbor.

These policies are based on the economic, environmental, and cultural characteristics of the Sag Harbor waterfront area, and represent a balance between economic development and preservation, which will permit beneficial use of and prevent adverse effects on Sag Harbor's waterfront resources. The policies shall serve as the basis for local, State, and Federal consistency determinations for activities affecting the LWRA. No policy shall be viewed as being more significant than another. These policies should be read in conjunction with the specific standards contained in relevant local laws of the Village.

Section IV - Proposed Land and Water Uses and Proposed Projects - - This section describes proposed long-term land and water uses for the Village's waterfront area, including a proposed land and water use map, and proposed short and long-term projects in the Village would like to pursue in order to implement their LWRP.

Section V - Techniques for Implementation - - This section describes the local laws necessary to implement the policies and proposed uses set forth in Sections III and IV.

Section VI - State and Federal Actions and Programs Likely to Affect Implementation of the LWRP - - This section consists of a list of State actions and programs which must be undertaken in a manner consistent with the Sag Harbor LWRP, as well as a description of specific State and Federal actions neccessary to further implementation of the LWRP.

Section VII - Consultation with Other Affected Federal, State, Regional, and Local Agencies - - The Village of Sag Harbor's LWRP will affect and be affected by the actions of adjacent municipalities and federal, State, regional and county agencies. THis section describes the interrelationship with other agencies and the efforts made by the Village to involve and/or inform other agencies regarding the development of the LWRP.

Section VIII - Local Commitment - - This section describes the actions taken by the Village to obtain local support for its LWRP, in order to identify the specific issues and concerns of local agencies, organizations, and other interested parties with respect to development and adoption of the Sag Harbor LWRP.

The six sections of the HMP are:

Section I - Introduction - - This section sets forth the community's vision for its harbor area, identifies the Harbor Management Area (HMA), and identifies the regulatory framework behind the implementation of the HMP.

Section II - Existing Authorities - - This seciton identifies and describes the existing political and regulatory jurisdictions related to the surface waters and underwater lands of the Sag Harbor Cove/Bay Complex.

Section III - Existing Land and Water Uses - - This section provides a summary the existing upland, water and underwater uses in the Sag Harbor Cove/Bay complex.

Section IV - Environmental Conditons - - This section identifies an assessment of the natural resources in the HMA, including surface water quality, ecological resources, and issues related to flooding and erosion.

Section V - Land and Water Regulations - - This seciton identifies the pertinent regulations related to land and water uses in the HMA.

Section VI - Water Use Plan: Issues and Objectives - - This section identifies local and regional issues, opportunities and objectives of importance.
